Chapter X

 Duties and Powers of the Township Registrar

36. The duties and powers of the Township Registrar are as follows:
(a) submitting to the Chief Registrar after scrutinizing the application to register as a labour organization in accord with the stipulation;
(b) requesting the requirements found on scrutiny under sub-section (a), from the relevant labour organization and staying the matter for registration during the period of requesting so;
(c) informing the decision of the Chief Registrar to the relevant labour organization in respect of the application to register as a labour organization;
(d) conferring the registration certificate to the labour organization permitted to register by the Chief Registrar;
(e) accepting and keeping the number of members and the financial statement of the relevant labour organization;
(f) submitting to the Chief Registrar in respect of the application for joining or secession of abour organization, after scrutinizing in accord with the stipulations;
(g) informing the decision of the Chief Registrar relating to the submission under sub-section (f) to the relevant labour organization;
(h) submitting to the Chief Registrar to deregister the registration as a labour organization due to any cause contained in section 33;
(i)instituting a case to the relevant competent court for deregistration of a labour organization in accord with the directive of the Chief Registrar under sub-section(d) of section 32 of this Law;
j) carrying out the duties assigned by the Chief Registrar from time to time.

タウンシップ登記官の義務及び権利

第３６条
(a)労働組合としてなされた登記申請を法令に従って審査した後、首席登記官に送達すること
(b)(a)項に沿った審査に基づいた必要提出物を関連する労働組合に要求すること、請求している間、登記手続きを猶予すること
(c)労働組合としての登記申請に関しての首席登記官の決定を関連する労働組合に通達すること
(d)首席登記官による登記の許可を得た労働組合に対して登記証明書を与えること
(e)関連する労働組合の組員数報告及び収支報告書を受領し保管すること
(f)労働組合の合併または分割に関して、法令に従って審査し、首席登記官に退出すること
(g)（ｆ）項に係る申請に関する首席登記官の決定を関連する労働組合に通達すること
(h)労働組合の登記を第３３条によって抹消するため首席登記官に送達すること
(i)法律第３２条(d)項により、首席登記官の指示により、労働組合としての登記を抹消するため、管轄裁判所に対して訴訟を提起すること
(j)首席登記官によって、随時、割り当てられた義務を果たすこと

みどりのくろかみ / the brilliant black color of your hair

美しい黒髪のことを『みどりの黒髪』と言ったりしますが、この『みどり』、色を表す『緑』ではないようですよ。「みどりは、そもそも色を意味する言葉ではな、新芽や若い枝そのものを指した」とのことをいうんだそうです。
島崎藤村という人が「若菜集」というのを書いてたと思いますが

このわかれ

嫁ぐ日の若く美しい妹におくったうただそうですが、いまよんでみたら、ちょっとグッときます。。。『みどりの黒髪』は若々しさと美しさをあわらす言い方なんですね。

五稜郭 Goryōkaku

またぞろ、小学校の話ですいませんが、函館の五稜郭はとても印象的でした。なんでこんなきれいでイカシタ形のモノが北海道の函館にあるのかとおもっておりました。

とにかく、デザインが日本的でないし、広陵とした大地にここだけ、異空間のような感じがしていたのです。そしたら、やっぱり、これはヨーロッパのリョウホ式の要塞建築をここ北海道に移植したものだとわかりました。

そして、残念ながら、この当時でも、もう古い形式だったんですねぇ。砲撃技術の方が格段に進歩したんでしょうか。。。

一番の問題としては、既にヨーロッパでもこのような稜堡式の築城様式は、いささか旧式化していたことである。堡塁を重ねるのは小銃を防御兵器として用いるための方式であり、当時のヨーロッパでは大砲を掩体壕に据えての防御へと移行しつつあった時期である。現に同時期の普仏戦争において、フランスの稜堡式の要塞はプロイセン王国軍に簡単に突破・攻略され、要塞形式として旧式化していることを露呈していた。稜堡式の陣地を築いた例は近現代でもあるが、あくまで野戦築城であり、恒久的な要塞としての築城例は無い。ちなみに同時期に東京湾に築かれた台場は、大砲を用いる要塞施設である。ウィキペディア

どうりで、デザインがヨーロッパ的だったわけだ。

２月の真冬の北海道函館は一度行ってみたかったのです。レンタカー借りなくてよかった。とてもじゃないが運転できなかったでしょう。ドリフトさせながら運転というのは地元に育ったひとでないとできないかも。。。

It was very cold winter,-10 degree Celsius, at Hakodate Hokkaido Feb.2013.I visited the fort 'Goryokaku' park near the center of Hakodate city in Hokkaido. It was the first trip for me.I have a good impression of a design of this fort from my childhood because of the same design as the design of an European castle.

Goryōkaku was designed in 1855 by Takeda Hisaburō. His plan was based on the work of the French architect Vauban.[1] It is shaped like a five-pointed star. This allowed for greater numbers of gun emplacements on its walls than a traditional Japanese fortress, and reduced the number of blind spots where a cannon could not fire.The fort was built by the Tokugawa shogunate to protect the Tsugaru Strait against a possible invasion by the Russian fleet.Goryōkaku is famous as the site of the last battle of the Boshin War (Goryōkaku no Tatakai). The fighting lasted for a week (June 20–27, 1869). by wiki

According to the stone inscription on Benten Island, the area between the Ueno Plateau and the Hongo Plateau used to be called Shinobugaoka (忍ヶ丘?), and the pond just took its name from it, but there are alternative theories. According to one, the early name Shinowazu (篠輪津 Shino wa zu?) due to the presence of bamboo grass later turned into Shinobazu. Another claims the name comes from the habit of young men and women to meet secretly here. by wikipedia

In the deep night sometimes I take a walk around this pond to exercise. 30 minutes walk is very good to keep a condition of my body.

In the night as there are not so much streetlamps it is dark around this pond. If there were NY,doubtlessly, it must be appointed to a very dangerous area and not recommended to visit for travelers.

In TYO situation is very different. This is the best point of a secret meeting for lovers. There are a lot of bench around the pond, so everybody will spend a good time to talk with friend or lover over watching skyscrapers in Ueno TYO.

Chapter VII
Dulies of En1ployer
29 The employer shall recognize the labour organizations of his trade as the organizations representing the workers.
30 The employer shall allow the worker who is assigned any duty on the recommendation of the relevant executive committee to perform such duty not exceeding two days per month unless they have agreed otherwise. Such period shall be deemed as if he is performing the original duty of his work.
31. The employer shall assist as much as possible if the labour organizations request for help for the interest of his workers. However, the employer shall not exercise any acts designed to promote the establishment or functioning of labour organizations under his domination or control by financial or other means.

使用者の義務
第２９条
使用者は、自社の労働組合が労働者を代表する組織であることを認識するべきである。
第３０条
使用者は、関連する執行委員会の認定を受けた仕事を割り当てられた労働者に対して、１箇月に対して２日間を超えない範囲で、当該仕事を執行する許可を与えなければならない。但、執行委員会が他の合意をした場合を除く。この期間は、当該労働者は、会社における本来の業務を果たしているものと見做される。
第３１条
使用者は、労働組合が労働者の利益のためになんらかの支援を求めた場合、可能な限りにおいて援助するものとする。但、使用者は、金銭的又は他の方法によって、労働組合を使用者の独占又は支配に置かれた労働組合として位置づけ確立する目的をもって当該援助を行ってはならない。

カスピ海

カスピ海を臨む

小学生のころから、結構地図をみるのが好きなのでしたが、カスピ海というのは、びわ湖なんかよりの格段に大きい湖であることが興味を引くのでした。地図を見ると確かに湖のように内陸にあるが、湖でなく、海とついていることが興味をますます、そそるのでした。

大人になって、カスピ海のネーミングに再会したのは、ヨーグルトです。+++カスピ海ヨーグルト+++これは、ねっとりしたヨーグルトでしたね。その後、イラン側のカスピ海を訪れる機会を得て、確かに「海だなあ」とわかったのでした。

しかも、海岸は結構リゾート地になっています。テヘランから近いこともあり、お金持ちがプライベートビーチにしている箇所もたくさんあります。ちょっとした不動産ブームですが、夏になると人がどっと押し寄せ、地元の人は「水不足でこまる～」と文句を行っているのでした。

スペインのマラガでも同じような状況があって、あまりに有名なビーチリゾートになってしまうと水不足がおこってしまうということあるようです。ハワイはどうなのでしょうか？どなたかご存知ありませんか？

カスピ海の海岸を撮ってありますのでご笑覧ください。ほんとにカスピ海なんですよ～。いつも風がボーボー吹いていたました。泳ごうとしたら、地元の人に強烈に止められました。「絶対帰って来られなくなる」というんです。泳ぎには自信がありますが、そんなに言われてやめました。。。

Chapter VI

Establishing and Expanding of Fund

24 The respective labour organizations has the right to establish a fund each separately.

25 The labour organizations;
(a) have the right to establish the fund, in accord with the constitution or rules of their organization, with admission fees for the labour organization, monthly contribution not exceeding two percent of the wages or salary obtained by the worker who is a member of the organization, income from the cultural and sports works which are undertaken by the labour organizations and the money donated by the relevant employer,
(b) shall deposit to the Fund if money is included in the grants provided by the Government
(c) shall abide by the provisions ofthe Control of Money Laundering Law.

26 The Basic Labour Organizations shall allocate the monthly contribution not exceeding two percent of wages or salary obtained by the worker who is a member of the organization to the Township Labour Organization,Region or State Labour Organizations,Labour Federations and the Myanmar Labour Confederation as prescribed by the relevant labour federation.

第６章

基金の設立及び支出

第２４条　各労働組合は、基金を各別に設立する権利を有する。

第２５条　労働組合は、（a）自らの労働組合の組合憲章及び規程に従って、組合の入会費、労働組合員になろうとする労働者が得る収入の２％を超えない範囲で月額組合費、労働組合が行う文化、スポーツ・イベントからの収入、関連する使用者からの寄付金などにより基金を設立する権利を有す。
（b）ミャンマー連邦政府より供与される現金は基金に預託されなければならない。
（c) マネーロンダリング法の規則を順守しなければならない。

第２６条　各単組は、労働組合員になろうとする労働者が得る収入の２％を超えない範囲で徴収した毎月の組合費を、タウンシップ労組、管区労組、州労組、ミャンマー労働組合連盟、ミャンマー労働組合総連盟等に、関連する労働組合連盟が定める所定の形式に則って配分しなければならない。
